Terms and Conditions

The plain-English terms that govern working with Own The Box Marketing.

1. Who we are

These Terms govern the marketing services provided by Own The Box Marketing LLC, a Rhode Island limited liability company ("Own The Box Marketing," "we," "us," "our"). Our authorized business address is 29 Hunters Ct, Saunderstown, RI 02874. We serve clients nationally.

By purchasing a plan or a one-time website build, or by using our services, you ("Client," "you," "your") agree to these Terms.

2. What we provide

We provide digital-marketing services for home-service and other small businesses. Depending on the plan you buy, these can include:

  • Website design, build, and hosting
  • Local search optimization (SEO)
  • Google Business Profile setup, optimization, citation and directory listings, and posts
  • Content (blog posts and related written content)
  • Online review requests and review management
  • AI-search visibility (Answer Engine Optimization for tools such as ChatGPT, Claude, and Google Gemini)
  • Managed Google Ads and Local Services Ads (search only; see Section 4)

The specific deliverables, volumes, and which items are included are set by the plan published at owntheboxmarketing.com/pricing at the time of your purchase, and by any written service agreement between us. Services not expressly listed in your plan are not included and are quoted separately.

We currently offer two monthly Full Service plans, Essentials and Launch, and a one-time website build option. The plans, prices, and what each includes are described on our pricing page and are incorporated into these Terms by reference.

3. Fees and billing

Full Service monthly plans. Full Service plans are billed monthly in advance. The current plans are Essentials at $299 per month and Launch at $399 per month. Your website build is included in the monthly plan at no separate charge. There is no setup fee, no minimum term, and no long-term contract. Your service continues month to month until you cancel.

One-time website builds. As an alternative to a monthly plan, you may buy a website outright: Professional at $2,900 or Optimized at $3,900, each as a one-time charge. After launch, a hosting subscription of $99 per month keeps the site live and secure and bills month to month until you cancel. A one-time build does not include the ongoing marketing services in the Full Service plans.

Additional locations. If you operate more than one physical location and want listing and citation management for an additional location, that is $25 per additional location per month, with no cap. This is optional and can be added or removed at any time.

Advertising spend is separate. Where a plan includes managed advertising, the advertising budget for paid campaigns is paid by you directly to Google and remains under your control at all times. Our management fee is separate from and does not include your ad spend. We do not mark up, hold, or control your ad budget.

Third-party costs. If something you ask for requires a cost payable to a third party (for example, registering a domain name), we tell you the cost first and do not incur it without your approval. Approved third-party costs are passed through and appear separately.

Price changes. We may adjust plan fees with at least sixty (60) days written notice. A change takes effect no earlier than your next monthly billing cycle after the notice period ends, and you may cancel before it takes effect if you do not accept it.

Failed payments. If a payment fails, we will notify you and attempt collection. Services may be suspended if payment remains outstanding after fifteen (15) days.

Cancellation and refunds. You may cancel at any time. Cancellation takes effect at the end of your current paid monthly cycle. You keep access and service through the end of that cycle, and then service stops. We do not provide refunds or proration for a partial month. See Section 11 (Termination) for what happens to your website and data on cancellation.

4. Advertising: Google and search only

Any managed paid advertising we provide is limited to Google search advertising and Google Local Services Ads. We do not run, manage, or sell paid social-media advertising. Our approach favors reaching people at the moment they are searching for a service, rather than interrupting them elsewhere.

5. No guarantee of results

We do not and cannot guarantee any specific Google ranking, Map Pack placement, search position, traffic volume, lead volume, revenue outcome, or that any AI answer engine will mention, recommend, or rank your business. Search and AI results are determined by third parties (including Google and AI providers) using factors outside our control, such as your proximity to the person searching, competitor activity, and changes to their algorithms and models.

Any person or company that guarantees you a specific ranking, or guarantees that an AI tool will recommend you, is making a promise they cannot keep.

What we do is work to improve the factors you can influence: your Google Business Profile completeness and activity, your review volume and recency, your website's technical quality and relevance, your content, and the consistency of your business information across the web. Our obligations are obligations of effort and diligence, not of a guaranteed result.

6. Listings and citations

Where your plan includes listing and citation management, we set up and maintain your business listings across the directories and data networks described on our pricing page, and we work to keep your name, address, and phone number consistent across them.

This maintenance continues only while you are an active, paid client. If you cancel, we stop maintaining your listings: the ongoing updates, the syndication across directory and data networks, and the monitoring all end. Because those networks change over time, listings can fall out of sync or drop off after maintenance stops. You keep any accounts you personally own, such as your Google Business Profile, but the ongoing work that keeps them consistent everywhere ends when your service ends.

7. Website ownership

You own: your domain name (always registered in your name and owned by you; we hold administrative access only and never own your domain), all content, copy, images, and materials you provide, your customer data and lead records, your Google Business Profile and its data, and your analytics history.

One-time builds. If you buy a website outright (Professional or Optimized), you own the website you paid for. A $99 per month hosting subscription keeps it live; if you cancel hosting, we will cooperate in transferring the site or its content to you or a host of your choosing.

Included builds under a monthly plan. Under a Full Service monthly plan, the website build is included as part of your ongoing service at no separate charge, and the website we build is yours to keep. On cancellation, you keep your domain, your content, your customer data, your marketing assets, and the website itself. If you want to keep your website live after cancelling, you can: we will not take it down, and we will work with you to keep it hosted or to transfer it to you or a host of your choosing, so you do not lose it. What ends on cancellation is the ongoing managed service, meaning the marketing work and the listing and citation maintenance described in Section 6. The website, domain, and marketing assets stay yours.

8. Your responsibilities

You agree to:

  • Provide the content, images, and business information we reasonably request
  • Grant and maintain the access we need, including Google Business Profile manager access
  • Respond to approval requests within five (5) business days
  • Ensure everything you provide is accurate and that you hold the rights to it
  • Maintain any licenses, insurance, or registrations your business requires
  • Comply with all applicable laws in your business operations

Delays caused by your non-response extend our timelines accordingly.

9. Reviews and communications

Where your plan includes review management, you authorize us to send review requests to your customers on your behalf and to draft responses to reviews in your business's voice. Review responses are submitted for your approval, and we do not post a response you have not approved.

You represent and warrant that you have obtained all consents required by applicable law, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM, for every contact whose information you provide to us, and that you have a lawful basis to contact them. You agree to indemnify us for any claim arising from a contact you provided without the required consent.

We will not gate, filter, or selectively solicit reviews based on whether we expect them to be positive or negative. We will not solicit, incentivize, or generate fake reviews, and we will not remove or suppress legitimate negative reviews. Doing so would violate Google's policies and the FTC's rule on consumer reviews (16 CFR Part 465).

10. Third-party services

Our services depend on platforms we do not control, including Google, Cloudflare, and others. We are not responsible for outages, policy changes, account suspensions, or service discontinuations by these providers, and we will act promptly to restore or replace affected services. Google Business Profile suspensions can occur for reasons outside our control; if your profile is suspended, we will assist with reinstatement at no additional charge, but we cannot guarantee reinstatement.

11. Termination

By you. At any time, with no notice required. Cancellation takes effect at the end of your current paid monthly cycle. You keep access and service through that cycle, then service stops. No refund and no proration.

By us. At any time, on the same basis: your service continues to the end of your current paid monthly cycle and then stops. We may terminate immediately if you breach these Terms, fail to pay after notice, or ask us to do something unlawful or in violation of a platform's policies.

On termination, Sections 6 (Listings) and 7 (Website ownership) govern what happens to your listings, website, and data.

12. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to these Terms shall not exceed the total fees you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, or lost data.

13. Indemnification

You agree to indemnify and hold harmless Own The Box Marketing LLC and its members from claims arising out of content you provide, contacts you provide, your business operations, or your breach of these Terms.

14. Changes to these Terms

We may update these Terms. Material changes will be communicated by email at least thirty (30) days before taking effect. Continued use after that date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Rhode Island.
